A statutory declaration is a formal statement you make to confirm as being true to the best of your knowledge and belief.
The declaration must be made before a person authorised to administer oaths, such as a solicitor, commissioner for oaths or notary public in order for it to be valid.
You may need to produce a statutory declaration in the following circumstances:
- You wish to legally adopt a new name.
- You do not have documents evidencing your nationality, marital status or another aspect of your identity.
- You need to confirm your solvency in respect of liquidation
- You are providing a statement in relation to land, rights of way or adverse possession
- You are taking the grant of a lease excluded from the 1954 Act.
The witness to your statutory declaration must have the authority to administer oaths and be independent, so cannot be the same solicitor who has prepared your documents.
£5 for each statutory declaration
£2 for each exhibit to a statutory declaration
The £5 only covers the ‘taking’ of the statutory declaration, which is to hear the declaration of the person making it;
“I [name] do solemnly and sincerely declare that this is my name and handwriting and that the contents of this my declaration are true by virtue of the provisions of the
Statutory Declarations Act 1835”
and then signing the form.
